Who Pays For Title Insurance & Who Selects The Company?

Probably the most common question from buyers, sellers, and real estate professionals is who pays for title insurance and who selects the title insurance company.   This is a great question, and it has a simple answer.  In Florida, for example in Pinellas County it is customary for the owner’s title insurance premium to be paid for by the seller and in Dade County it is completely opposite, it is customary there for the buyer to pay for the owner’s title insurance.  The key word here is customary and ultimately it is negotiated in the contract with a simple check box on the contract as shown here.

Who Selects The Title Insurance Company?

That is also a simple answer, it is the party in which is paying for the owner’s title insurance premium within the contract.  If the buyer pays, then they select the title insurance agency, and if the seller pays, then they select. You have the right to choose what title company is used so do due your diligence prior to choosing. We would love to earn your business, and are here for any and all questions at 727.538.4228.
